A Gurnee man was convicted by a jury Wednesday on two counts of unlawful use of a weapon by a felon due to an incident in which he was shot in the foot and then fired back at the men who shot him outside of a Waukegan restaurant, according to authorities.

Dontra Davis, 25, faces a sentence ranging from three to 14 years in prison at his sentencing hearing, preliminarily scheduled for May 8.

Davis was convicted by a jury after about two hours of deliberations Wednesday afternoon. His trial began Monday before Judge Daniel Shanes.

According to Assistant State’s Attorneys Lauren Kalcheim Rothenberg and Ari Fisz, Davis had been in Gojo’s Cafe on Belvidere Road in Waukegan, departed the restaurant in the early morning hours of Aug. 20, 2016, and was shot in the parking lot by one of three men who then fled in a vehicle. Davis was shot in the foot and recovered, authorities say.

The men also shot and injured a security guard in the lower leg while apparently firing at Davis, Rothenberg said. His injury was also described as not life-threatening.

Rothenberg said that after Davis was shot, he went to a vehicle, recovered a gun and fired at the men fleeing in their vehicle. The three men were never arrested or even identified, she said.

According to Rothenberg, surveillance video caught the shooting, but it was not clear enough to identify the other men involved.

Ballistic tests on evidence found in the parking lot showed that three guns had been fired in the incident, Rothenberg said. She said DNA testing of blood found at the scene matched Davis.

Attempts to reach defense attorney John Murphy for comment were not successful Thursday.
