The Illinois Supreme Court rejected a Geneva restaurant’s appeal of a ruling that upheld Gov. J.B. Pritzker’s indoor dining ban in response to the coronavirus pandemic.
FoxFire Tavern asked the Supreme Court in December to overturn an appellate court ruling in favor of Pritzker, but the court denied the petition Wednesday.
“The governor is pleased the court rejected this request and sided with upholding Gov. Pritzker’s ability to follow the science and protect the citizens of Illinois,” said Pritzker’s press secretary Jordan Abudayyeh.
The restaurant was among many that sued Pritzker after he announced restrictions on businesses because of the pandemic.
On Oct. 23, FoxFire filed a complaint and a Kane County judge granted the restaurant’s request for a temporary restraining order, allowing them to ignore the indoor dining restrictions.
The 2nd District Appellate Court overruled the decision in November, finding the governor’s order valid under the Emergency Management Agency Act that gives the governor certain powers during a disaster.
Following the decision, the case was consolidated in Sangamon County court with several other cases and the lawsuit remains pending.
