Witnesses told police the men bumped into each other as Moffett got his to-go order at Perros Bros. Gyros and was leaving. An affidavit alleges McCoy drew a gun and followed Moffett to a car.
After McCoy opened fire, Moffett shot back, documents state.
It does not provide more details on any further motive.
Gary Police responded June 8 to the 3100 block of Richard Hatcher Boulevard, formerly Grant Street.
They found several casings in the parking lot.
Moffett was shot in the head, torso and arm. His death was ruled a homicide. McCoy was wounded and taken to the University of Chicago Medical Center.
A witness said it was raining before Moffett went to his car.
“Are we good, bro?” McCoy asked twice.
A woman told police McCoy raised a gun as Moffett tried getting to the car.
“It doesn’t need to be like that,” he told McCoy.
Moffett walked around the vehicle and collapsed. Someone helped McCoy back into his black Jeep, which was parked next to them, before the vehicle took off.
Police used license plate readers to tie the vehicle to McCoy. After a search warrant, they found “several bullets” and a barrel-less handgun inside McCoy’s home.
McCoy declined to talk to police at the hospital.
