No criminal charges will be filed against the 16-year-old teenager behind the wheel of vehicle involved in the July 17 crash that resulted in resulted in the death of 14-year-old Sean Richards and injuring three others, DuPage County State’s Attorney Robert Berlin and Hinsdale Chief of Police Brian King said in a statement Wednesday.

After a three-month investigation the DuPage County MERIT Major Crash Investigation Team, Hinsdale Police and DuPage County State’s Attorney’s Office concluded the driver will face three traffic offenses but will not be charged with any criminal offenses.

“The tragic death of Sean Richards was a horrible accident, and the subsequent investigation was particularly difficult for those involved,” Berlin and King said in the statement. “We personally want to thank the first responding men and women directly involved at the accident scene for their efforts.”

The driver of the vehicle would be cited with failure to exercise due care to avoid colliding with a pedestrian, failure to yield the right of way to a pedestrian on a sidewalk and failure to decrease speed to avoid colliding with a person, according to the statement.

“The findings of the investigation and our decision to not pursue any further criminal charges in this case are based on criminal law and we offer no opinion on the civil liability of any party involved in this case,” they said in the statement.

On July 25, three of the victims injured in the crash filed a lawsuit

against the drivers father and employer, Fuller’s Car Wash, where the driver was working at the time of the accident.

The plaintiffs — Sophia Ricciardi, Michal Lizler and Connor Sullivan — were inside the restaurant at the time of the accident, according to their attorney, are seeking monetary compensation for physical and emotional damages suffered as a result of the crash, with each count of negligence calling for $50,000 plus the cost of the lawsuit.
