Two Elgin brothers who shot a man during a fight over two women and then kicked the injured Elgin man as he lay dying were sentenced to prison Monday.

Xavier L. Butler, 28, of the 200 block of Windsor Court, pleaded guilty to armed violence, a class X felony, in exchange for a 30-year term in the Illinois Department of Corrections for his role in the fatal shooting of Joshua Tyler Bey, 24, on Aug. 6, 2019.

Isaiah Y. Butler, 24, of the 200 block of Locust Street, received a 15-year term after pleading guilty to second-degree murder, a class 1 felony.

The incident occurred about 10:30 a.m. in the parking lot of an apartment complex in the 1200 block of Fleetwood Drive, reports said.

Bey and a friend met Xavier and Isaiah Butler in the parking lot to continue an argument that had started the previous day over two women, according to the Kane County State’s Attorney’s Office.

Bey had pulled out his gun when Xavier approached, but kept it at his side, a news release said. As the argument escalated, the brothers began to push Bey and Isaiah Butler punched Bey, which triggered a physical fight during which Xavier Butler shot Bey and took Bey’s gun.

During the struggle, Xavier Butler also shot his brother in the thumb, the report said. While Bey was on the ground fatally wounded, the brothers kicked him and then fled the scene, ultimately heading to Milwaukee.

“Isaiah Butler was convicted of second-degree murder because he unreasonably believed that he and his brother faced imminent danger,” the release said. “Although Xavier Butler also could have been convicted of second-degree murder, he was convicted of armed violence because the accompanying sentence most accurately reflects his criminal actions.”

Thirty years is the maximum sentence for armed violence and 20 the maximum for second-degree murder, release said.

Both men will get credit for the 937 days they served in the Kane County jail awaiting the resolution of their cases.
