The parents of Andrew “AJ” Freund, the 5-year-old Crystal Lake boy who was killed last month, were formally indicted by a grand jury Thursday on charges of murder, concealment and battery in the boy’s death, according to McHenry County court records.
The indictments against Andrew Freund, 60, and JoAnn Cunningham, 36, also include charges related to two other alleged incidents, records show.
Freund and Cunningham are scheduled to appear in court at 9 a.m. Friday and could plead to the charges then.

The two remain in custody at the McHenry County jail on $5 million bail each, accused of beating their son to death April 15. They were arrested and initially charged April 24.
They each face multiple charges of murder, aggravated battery to a child under the age of 13 causing permanent disability and concealment of a homicide, among other crimes, according to court documents.
Each is also charged with aggravated battery to a child younger than 13 causing permanent disability for an alleged beating of AJ in March that authorities say was found video-recorded on Cunningham’s cellphone.
The indictment also includes charges of reckless conduct, unlawful restraint and child endangerment for an incident with a reference date of Sept. 20, 2018, records show. Details of those charges were not immediately available.
However, Crystal Lake police reports released last month show that police went to the family’s house that day for a well-being check after a neighbor reported that power was out in the house. Cunningham denied police entry into the house, but an officer reported seeing both children and that they appeared “healthy and happy.” The Illinois Department of Children and Family Services was informed of the well-being check but told police that the lack of power was not enough to justify further investigation, police said.
Freund reported his son missing April 18. After nearly a week, the boy was found dead, wrapped in plastic and buried in a shallow grave near Woodstock.
