Jorge Diaz pleaded guilty to aggravated battery with a firearm in exchange for 12 years in prison, according to court documents. As part of the agreement with Kane County prosecutors, he also received credit for 527 days spent in Kane County Jail since his March 2016 arrest.
Diaz is now the fourth of five men charged in the case to be convicted and sent to the Illinois Department of Corrections relating to the shooting that occurred in November 2014 on Coral Avenue.
Authorities allege Diaz accompanied Jordy Arreola to a meeting where he would supposedly sell marijuana to Antonio Isais. However, Isais arrived with Andres Fonseca and Patrick Maloney with intentions of taking the drugs from Arreola, who actually planned to steal cash from Isais, police and prosecutors previously said.
At least one person associated with each side arrived with a gun and a shootout resulted. Court records state Diaz shot Isais, while Fonseca is accused of firing at Diaz. Fonseca’s case remains pending, although he pleaded guilty to an unrelated unlawful restraint charge earlier this year and was sentenced to three years in prison.
The three others involved in the shooting received prison sentences of between four and six years after pleading guilty to robbery-related charges. Isais has since been paroled, while Arreola and Maloney are scheduled for parole in 2018.
