A man extradited from Georgia last week is charged with murder in the death of an accomplice killed while trying to rob several people outside a Near North Side restaurant last fall, prosecutors said Sunday.

Cornelious Duffie, 21, was ordered held on no bail in connection with a Sept. 18 shooting that left 20-year-old Marquese Fleming dead and a 30-year-old man seriously wounded. In the days after the shooting, police released video surveillance of someone connected with the incident. Prosecutors on Sunday said that Fleming was shot when he, Duffie and four other people tried to rob the friends of a man who had been in the fast-food restaurant.
The six attackers tried to rob three men sitting in a car outside Mr. Gyros restaurant, 109 W. Division St., just before 4 a.m. that day, according to Assistant State’s Attorney Jullian Brevard. Duffie was armed with a silver handgun at the time.
The owner of the car, who was ordering food inside the restaurant, saw what was going on and confronted Duffie and the other attackers. He got a semiautomatic handgun from his glove compartment and fired at least six shots at the group just after 3:55 a.m.
Fleming, of the 1000 block of North Larabee Street, was shot in the back. The 30-year-old victim, a bystander who had just bought food from the restaurant, was walking down Division Street and was hit by a stray bullet.
They were taken to Northwestern Memorial Hospital, where Fleming was pronounced dead. The other man initially was listed in serious condition with a gunshot wound to the back.
Three witnesses identified Duffie as one of the people who brandished a gun and tried to rob the vehicle, according to prosecutors. Duffie, of the 1100 block of North Hudson Street, was extradited Friday from Clayton County, Ga.
Court records show he was charged with being a fugitive from justice in Clayton County on Jan. 26. He was ordered extradited following the presentation of a warrantless arrest affidavit in court last week, according to court records.
