An Aurora man accused of sexually assaulting a woman in 2015 has opted against a jury trial, which would have started Monday.
Andres Fonseca, 22, faces multiple counts of sex abuse and assault and will now face a bench trial before Kane County Judge Linda Abrahamson March 20. He is also charged in an unrelated shooting, but prosecutors have elected to go forward on the assault case first.

Fonseca and 22-year-old Stephawn Johnson were charged last year with assaulting a 19-year-old Aurora woman at an apartment on South Lincoln in May 2015. Authorities said the woman met Johnson, Fonseca and two others before attending a party at the apartment. While there, Johnson offered the woman what he described to be Xanax, which she took and later said made her feel drowsy and weak, police said. When an acquaintance of the woman and a second man left the apartment to buy alcohol, Johnson and Fonseca assaulted the woman and took her cell phone, according to police and prosecutors.

A jury convicted Johnson in October and Abrahamson sentenced him to 11 years in prison during a December hearing. On Tuesday, Abrahamson denied Johnson’s motion asking her to reconsider the sentence.
