A 28-year-old Aurora man is accused of battering a gas station clerk in the city Sunday.

According to Aurora police reports, officers were called to Marcley’s Gas Station, 600 block of North Broadway Street, around 6:30 a.m. for reports of a disturbance.

Police said Miguel Vargas, 700 block of South Union Street, Aurora, entered the gas station and asked the store’s clerk for some cigars that were located behind the counter. At some point, Vargas became angry and began yelling profanities at the clerk, police said.

The clerk reported that Vargas eventually went around the counter and grabbed the cigars on display, police said. The clerk tried to get away from Vargas, but was hit, kicked and thrown to the floor, he reported.

Police said the clerk was able to break free from Vargas and run out into the parking lot. Vargas followed the clerk outside and ordered him to lay on the ground as he continued to yell profanities at him, police said.

Police officers found Vargas in possession of several cigars and energy drinks for which he did not pay. They also located approximately 14 grams of marijuana inside a vehicle Vargas had driven to the gas station, police said.

After he was taken into custody, 1.6 grams of heroin was found in Vargas’ possession, police said.

He was charged with felony possession of a controlled substance, battery, resisting a peace officer, possession of marijuana and disorderly conduct.

The clerk did not require medical attention, police said.
