The attorney defending a Geneva man against a string of charges, including trying to carjack a woman’s SUV in Batavia in May, has raised doubts about his client’s fitness to stand trial, according to court records.

Marvell Frye, 23, remains in Kane County Jail facing allegations he stole a jacket from a store, used a small wrench to assault a furniture store manager and accosted a woman in a Randall Road store parking lot in an attempt to take her Chevy Suburban all on May 20. He has not yet been arraigned on attempted vehicular hijacking, retail theft and assault charges.

During an October hearing, Kane County Judge D.J. Tegeler ordered Frye to be evaluated to determine if he is dealing with any mental illness. Recently, attorney Robert Stroh told Tegeler he had doubts about Frye’s fitness to assist in his defense, prompting Tegeler to request a Kane County Diagnostic Center psychologist to generate a report on Frye in anticipation of a fitness hearing.

Tegeler scheduled a Jan. 18 court date for an update on the new evaluation.
