When the Ricketts family purchased the Chicago Cubs in 2009, there were 16 rooftop clubs lining Waveland and Sheffield avenues across from Wrigley Field. At the time, the rooftops were operating under a revenue-sharing agreement that their owners signed with the Cubs in early 2004.
In 2015, the Ricketts family began acquiring the rooftop businesses, a process that has accelerated with the dismissal of a lawsuit filed by several rooftops saying the Cubs violated the revenue-sharing agreement by installing outfield video boards.
The Ricketts family owns or controls 10 of the 16 rooftops, and it is targeting the takeover of another in a lawsuit. Five non-Ricketts owners remain.
The property most recently acquired by the family in March 2016 is the Brixen Ivy building at 1044 W. Waveland Ave. This operation is not owned by the Cubs or the Ricketts family members themselves. Instead, it was purchased by 1044 Waveland Holdings LLC, which is controlled by the Ricketts family. Similar business structures have been used by the Ricketts family to make other rooftop purchases.
“The family continues to be interested in acquiring some of these buildings if there are owners who are interested in selling,” family spokesman Dennis Culloton told the Tribune in January. “We’re going to be able to create a variety of rooftop experiences for fans to choose from.”
The rooftops’ revenue-sharing agreement with the Cubs expires at the end of 2023.

In October 2015, Lakeview Baseball Club and Skybox on Sheffield asked U.S. District Court Judge Virginia Kendall to reconsider her decision to dismiss their lawsuit against the Chicago Cubs and asked permission to file an amended complaint. The two businesses, owned by commodities trader Edward McCarthy, requested Kendall allow them to amend claims related to antitrust violations by the team in its pursuit of acquiring rooftop businesses. Besides McCarthy’s two rooftops, Murphy’s Rooftop is the only one on Sheffield without any Ricketts investment or ownership stake.
