Herminio Umana, 43, who last lived on Midfield Drive, pleaded guilty in January to one count of predatory criminal sexual assault and received a six-year prison term in connection with his 2013 arrest. In his plea, Umana admitted to having sex with a female relative under the age of 13 during an eight-year time frame, according to court records.
At a Jan. 21 hearing on Umana’s plea, Kane County Judge John Barsanti agreed, over the objection of Assistant State’s Attorney Lori Schmidt, to let Umana turn himself over to authorities Feb. 5.
Defendants who agree to jail or prison time as part of a plea agreement typically are taken into custody the same day if they were previously out on bond. Umana had been free on $100,000 bail. He did not show up for court and is now wanted on a pair of warrants — one for failing to appear as required Feb. 5 in the sex assault case and a second one alleging a new charge of escape, which is tied to his missed surrender, court records show.
Umana was originally charged in October 2013 with the Class X sex assault, aggravated sexual abuse and with showing the female pornographic material. The other counts were dismissed as part of Umana’s plea to the most serious charge.
