A Chicago man accused of a 2012 sexual assault near the Aurora University campus avoided jail this week in connection to a missed court appearance earlier this month, court records show.

Cordero Pollard, 25, is charged with having sex with a woman who was too intoxicated to consent after a night of drinking. He was one of three men initially accused of assaulting the woman. Pollard was schedule to appear in court on Sept. 3, but failed to show up, which prompted a warrant to be issued, according to court documents. He attended a Wednesday hearing where prosecutors objected to the warrant being quashed. Pollard is set to return to court on Oct. 28. No trial date has been scheduled.

Pollard’s co-defendant, 24-year-old Eric Stallworth of Chicago, was originally scheduled for trial this week before pleading guilty to unlawful restraint on Aug. 27. He was sentenced to two years of probation and 23 weekends in the Kane County Jail, court records state. Earlier in the case, prosecutors sought to have Stallworth and Pollard tried in a joint trial, suggesting evidence against the pair was identical.

A third man – Shammrie Brown – was initially charged with criminal sex assault for failing to intervene on the woman’s behalf, but prosecutors later dropped that case and instead charged him with misdemeanor battery. Brown is listed as a potential witness for prosecutors, court records show. He has a Sept. 22 court date scheduled.
