Almost two years after being initially charged, a man in Lake County Jail awaiting trial for aggravated DUI and reckless homicide in the death of a Buffalo Grove woman has been hit with 10 additional counts of the same charges.
The defense attorney for Stephen Tomczyk of Long Grove said Thursday he will move to dismiss the new indictments against his client, which were approved last week by a Lake County grand jury.
Defense attorney Eric Rinehart said he believes his motion to dismiss the new indictments will be heard Tuesday, the same day a hearing is scheduled for a motion to suppress evidence in the case.
Tomczyk, 22, was initially charged with six counts of reckless homicide, three counts of aggravated driving under the influence of drugs resulting in death and three counts of aggravated DUI resulting in death connected with a Long Grove crash that killed Jeewon Kim of Buffalo Grove.
According to authorities, Tomczyk was involved in a Sept. 5, 2013, crash on Route 83 with a car driven by Kim, who was pronounced dead at the scene. A female passenger in her vehicle sustained serious injuries but survived.
Tomczyk pleaded not guilty to the 10 new counts of aggravated DUI and reckless homicide before Judge Mark Levitt on Wednesday.
Rinehart said Thursday that he believes the prosecution’s move in filing the new charges, though successful before the grand jury, is well past the time for such additional charges to be filed.
Assistant Lake County State’s Attorney Ryan Koehl the state is charging Tomczyk with counts of the same charges in additional, different ways. Some counts of the aggravated DUI charges specify great bodily harm and others specify death.
Last fall, Tomczyk rejected initial offers of a plea deal from the state’s attorney’s office.
He is currently scheduled for trial Aug. 24.
If convicted of the charges at trial, Tomczyk could receive up to 14 years on the aggravated DUI charges and two to five years for reckless homicide, as well as additional sentences for lesser charges.
Tomczyk is being held in Lake County Jail in lieu of $500,000 bail.
