Modesto Alarcon had contended police failed to read him his rights before talking with him for four hours, a conversation that involved Alarcon’s acknowledgment of a large quantity of heroin at his Grove Street home in Aurora in April 2014, police said.
Prosecutors later charged Alarcon with having nine kilograms of the drug – with an estimated street value of $1.35 million. A police search of the home turned up $85,000 in cash, a loaded handgun and armor-piercing bullets, records state.
An indictment included charges of heroin possession and distribution, as well as various financial crimes.
Alarcon, who remains held in Kane County Jail on $15 million bail, said in his motion that officers “forgot” to advise him of his Miranda rights and didn’t stop their questioning until after he had given statements to police, court records show.
Kane County Judge Clint Hull denied the motion.
Alarcon is scheduled to return to court on June 5.
