An allegedly drunk Aurora man couldn’t resist heading to McDonald’s for food at 1:30 a.m. Monday after already being warned by police not to drive.

The incident first began around 12:08 a.m. Monday when Aurora police were called to a home in the 500 block of Sixth Avenue for a noise complaint. A resident reported that someone parked in a maroon Jeep was playing his music too loudly.

On the scene officers found Daniel Garibay, 23, 0-99 block of North Kendall Street, sitting in the driver’s seat of the vehicle.

According to police reports, Garibay appeared to be drunk and was warned by officers to stay home and not drive. With the noise situation resolved, officers left Garibay. An hour and a half later, Garibay told police he got hungry. So, he headed to McDonald’s.

At 1:34 a.m., the same officers responded to McDonald’s in the 700 block of East New York Street for an employee complaint. Someone inside a maroon Jeep was causing trouble in the drive-thru line, police were told.

When they arrived, police recognized Garibay as the man they had dealt with earlier. He was driving the vehicle and was allegedly threatening to fight another customer in line. The restaurant manager told police Garibay appeared confused and had trouble speaking while ordering his food. At that point, she believed he was intoxicated and called police.

Officers located Garibay at the restaurant and he was charged with drunken driving.
