The attorney for a Geneva teen accused of sexual assault last summer wants a judge to throw out his statements to police and to quash his arrest.
Quinn Moore, 19, was charged with criminal sexual assault and sexual abuse on allegations he forced a 17-year-old female to fondle him and perform a sex act on him last summer.
The female went to police in the early morning hours of June 30, which prompted a sheriff’s deputy to go to Moore’s house for initial questioning.
According to the motion filed by Moore’s attorney, the deputy told Moore’s parents he wanted to talk inside his squad car without them present. Moore sat in the back seat and was “not free to leave” when he provided information to the deputy, all of which occurred without Moore being informed of, or signing a waiver to forgo, his rights, Moore’s attorney contends.
The motion also says Moore’s questioning was recorded by a squad car camera without his knowledge and that police again elicited information from Moore during an interview at the sheriff’s office. Prosecutors have not yet filed a formal response.
Moore, who is free on $100,000 bail, is scheduled to return to court March 23 when a hearing is expected on the motion to suppress his statements and dismiss his arrest.
He has pleaded not guilty to the charges.
