Jimmy John’s is letting patrons know that they may be able to claim a free side item due to the lack of sprouts on some of its sandwiches.
The giveaway stems from a class-action lawsuit filed against the sandwich chain. Plaintiff Heather Starks filed a lawsuit alleging that she bought sandwiches that were supposed to include sprouts, but did not. Jimmy John’s denied the allegations, but said it chose to resolve the matter with the side item giveaways, up to $725,000, less the actual costs of administering the settlement.
Now, anyone who fills out an online form claiming they were wronged due to the lack of sprouts can be righted with a free cookie, pickle, chips or soda.
Anyone who bought a sandwich between Feb. 1, 2012 and July 21, 2014 that was described as having sprouts but did not actually have the topping can participate in the settlement. Sandwiches such as the company’s Vegetarian, Totally Tuna, Turkey Tom, Beach Club, Gourmet Veggie Club or Club Tuna may have listed sprouts as an ingredient, even if they were not put on the sandwich.
According to information on the Jimmy John’s website and on a paper handout at the restaurant, the class action has been tentatively settled. Terms include that patrons who submit a timely claim would get a voucher for the free side.
Those who wish to participate will have to wait until a form is available on the jimmyjohns.com website, which won’t be ready until after the settlement is approved by Los Angeles Superior Court. A settlement hearing on the class action settlement is set to be held in Los Angeles on Dec. 4. Patrons don’t have to go to qualify.
Jimmy John’s also agreed to make at least $100,000 in donations to charity, depending on how many people complete the online claim form in a timely manner. And Starks stands to get $5,000 as compensation for acting on behalf of the class.
