Lawyers for Montana Atty. Gen. Mike McGrath have filed an emergency motion in federal court alleging that lawyers for the Innocence Project violated a court order by allegedly releasing sworn statements taken from McGrath and two other state officials.

The motion seeks sanctions against Peter Neufeld and the Innocence Project, which represents Jimmy Ray Bromgard, who was wrongly convicted of a 1987 rape and exonerated after serving 15 years in prison. Neufeld is accused of releasing the documents in violation of a court order prohibiting their release in a civil suit.

“There was no breach of confidentiality,” Neufeld said Friday. “What’s really going on here is that Mike McGrath wants to avoid the humiliation and embarrassment of his ridiculous statements under oath being made public.”

The motion also contends that jurors in the case would be unfairly influenced by the Tribune article, which McGrath’s lawyers say “is inflammatory and grossly mischaracterizes McGrath’s testimony.”
