The teacher is “no longer with the school district,” according to District 129 spokesman Mike Chapin, although he would not say when the teacher left or whether the departure was related to the allegations.
The 26-year-old teacher, whom the Tribune is not naming because he has not been charged, is being investigated by Batavia police for alleged “criminal sexual assault and/or aggravated criminal sexual abuse” of a student who was 17, according to an affidavit for a search warrant filed in Kane County Court. The teacher was 25 at the time.
The search warrant, dated April 12, was requested by a Batavia police detective after he received a tip from an Aurora police officer. Aurora police confirmed Friday that the initial investigation by Aurora police was turned over to Batavia police.
The affidavit describes a reported meeting between the teacher and student at a Batavia industrial area, and the officer seeks the search warrant to collect e-mails between the two.
The detective spoke with the West Aurora High School principal about the alleged incident and received a report on it. The principal also told the detective that a company did computer forensics on the student’s home computer and the teacher’s school computer, the document states.
The affidavit said the pair “had a relationship beginning in May/June 2005” when the girl was a student in one of his classes. They met several times outside of school and e-mailed each other more than 35 times, the affidavit says.
The student told police she met the teacher outside of school several times, including lunch at a restaurant in Geneva, a picnic at a St. Charles park, at his house, and at the Batavia industrial area, according to the affidavit.
