The state Gaming Board on Wednesday asked the Illinois Supreme Court to transfer a lawsuit challenging the planned casino in Rosemont from Lake County to Cook County.

Lawyers with the state attorney general’s office, which represents the Gaming Board, argued that the high court should intervene in the suit to protect the Gaming Board’s right to be sued only in an appropriate court.

Lake County Riverboat LP, a group of investors that wants to build a casino in Fox Lake, filed suit last month to try to block the Rosemont casino and overturn the state’s most recent gambling law.

Judge John Goshgarian has ruled that the lawsuit can proceed in Lake County because the investor group prepared its gambling license application there.

That application is part of the overall transaction that is the subject of the lawsuit, the judge concluded.

In its motion Wednesday, state attorneys argued that Goshgarian’s “reasoning would allow everyone to preselect a forum merely by unilaterally preparing and mailing out otherwise innocuous documents.”
