An attorney for a Hanover Park family is expected to ask a federal judge Tuesday to order the Hanover Park Police Department to secure 911 tapes from an incident last month in which the family’s epileptic son died while police allegedly restrained him during a seizure.

The family of Eric Stetter, 26, has filed suit against the village, claiming that police caused Setter’s death by denying him medical treatment and using excessive force to restrain him.

An amended complaint was filed Monday, accusing the village of “treating individuals having epileptic seizures the same as those individuals suspected of a crime.”

Efforts to reach an attorney for the village for comment Monday were not successful.

The suit says the family called 911 on Oct. 9, requesting an ambulance for their son, who was having a seizure. The suit said two officers initially showed up with paramedics and were later joined by several other officers.

The suit asserts that the family told the officers that Stetter was epileptic and showed them his medications, but the officers tackled and handcuffed him and bound his legs before placing him face down on a couch and piling on him to restrain him.

The suit also says that the officers had no probable cause to suspect Stetter of any crime, and that the officers’ actions amounted to a false arrest.

The Cook County medical examiner’s office has not yet ruled on a cause and manner of death.
