A legal dispute over a 1988 agreement is holding up expansion of a subdivision, plan commissioners said last week.

The Plan Commission voted to recommend denial of developer William Bolker’s plan for the eastern side of the Wildwood subdivision because the proposal doesn’t meet the village’s standards for open-land donations. Bolker’s original agreement with the village is also in litigation.

Under a 1988 agreement, four acres near Gear Drive and Joliet Highway were set aside for a private recreational complex for Wildwood residents, but the center was never built because Bolker’s plans failed to get Village Board approval.

Bolker said he is meeting his obligations under the original agreement, which he said is legal until a court rules otherwise.

But Plan Commission Chairman Cory Lund said the new proposal has to be judged independently because the original agreement is the subject of “a good-faith dispute.”

Because the expansion does not include open space, it does not meet the requirements of the subdivision ordinance now in force, Lund said.
