A Kane County judge has extended until Sept. 8 a temporary restraining order barring North Aurora from annexing property in dispute with Batavia. On that day Judge Patrick Dixon will hear evidence on Batavia’s motion for a preliminary injunction.

The motion was filed three days after Batavia filed a lawsuit over North Aurora’s plans to develop the Jones Farm into a subdivision of single-family homes. The 124-acre farm is on both sides of Mooseheart Road, which borders the two towns. Batavia officials said the annexation would violate a boundary agreement.

“This will give everybody time to prepare for the hearing and maintain the status quo,” said attorney Rory Weiler, a former Batavia alderman who is representing Batavia in the dispute.

Two years ago, North Aurora entered into an agreement with New Jersey-based Ocean Atlantic developers to annex all of the disputed land for the proposed subdivision, officials said. Batavia has expressed concern about the density of the proposed development.
