A Wheaton resident is trying for the second time to kick school board candidate Robert Davis off the Nov. 4 ballot.

Late last month, three candidates for Wheaton Warrenville Unit School District 200 board were removed because of challenges involving petition irregularities.

Joseph Mahady, a Wheaton resident, has asked the DuPage County Circuit Court to reverse the ruling last week of a three-member panel allowing Davis to stay on the ballot. Mahady alleged Davis’ petitions have flaws that did not leave him with the minimum of qualified signers.

Mahady’s attorney, Keri-Lyn Krafthefer, said the panel erred in finding the petition valid because Davis violated two state election rules.

She contended that although Davis acknowledged on three petition sheets that he witnessed signatures, witnesses at the hearing said he did not, and Davis did not specify on his petitions that he is running for a four-year term until after they were signed.

The panel ruled these are not fatal flaws for Davis’ petition. Davis said at the hearing he should not be thrown off the ballot for what he regards as technical violations. The panel agreed.

If the new challenge to Davis is successful, there would be no competition for four of five seats on the school board that will be decided by the voters in November.
