A concrete-crushing business that probably would be eliminated if Prospect Heights goes ahead with plans for a proposed 12,000-seat sports and entertainment arena filed suit in Cook County Circuit Court Tuesday challenging the legality of the project.

The lawsuit was filed by attorney Jeffrey Randall on behalf of Doetsch Bros. Co., an excavation and concrete recycling firm at 35 E. Palatine Rd.

The lawsuit says the city of Prospect Heights violated state law when it created a tax increment financing district to allow the city to acquire property for the arena through condemnation powers.

Doetsch Bros. said the city, in creating the TIF district, improperly contended that the area is “blighted.”

Randall said the lawsuit asks the court to prevent Prospect Heights from condemning Doetsch Bros. property until the lawsuit is decided.

Mayor Edward T. Rotchford has said the city prefers to buy out the property owners voluntarily to create space for the arena.
