A Kane County judge is scheduled to rule Friday on a motion to throw out murder charges against Craig Zimmerlein for the death of his 3-year-old stepson.
Zimmerlein, 29, is charged with two counts of murder and one count of aggravated battery to a child in connection with the March 20 beating of Travis Follman in their Campton Township home.

Zimmerlein’s attorney, David Camic, is seeking dismissal on grounds that the prosecution exceeded testimony limits to be presented to the grand jury imposed by Chief Judge Gene Nottolini.
Camic charged during a hearing Thursday in Judge James T. Doyle’s courtroom that allowing extensive grand jury testimony by immediate family members represents an abuse of the grand jury process.
