The owner of Grove Shopping Center has dropped a $5.6 million lawsuit he filed in federal court against the village and Mayor Dennis J. Gallitano.
This action came after the village told the owner, Joseph Serfecz, that it would not pursue any redevelopment discussions regarding the mall as long as the lawsuit was pending, according to Gallitano.
Lynda J. Khan, the attorney for Serfecz, had charged Gallitano and the village with violating her client’s 1st Amendment right to seek redress from the courts on a $51 million antitrust lawsuit Serfecz filed against Jewel Food Stores.
Serfecz claimed in the antitrust lawsuit that Jewel, which vacated the anchor store in Elk Grove Shopping Center in 1987, was conspiring with the developers, owner and operators of nearby Elk Crossing Shopping Center to bridle trade at his mall.
