The city plans to file an appeal with the Illinois Pollution Control Board seeking to block the expansion of Settler’s Hill Landfill.

The appeal will argue that Geneva and Kane County share siting jurisdiction over the dump because at least a third of the facility at Fabyan Parkway and Kirk Road is within city limits.

The city is hoping the question of joint jurisdiction, if decided in Geneva’s favor, would nullify the County’s Board’s approval last month of a plan to allow an additional 5.5-million cubic yards to be dumped there.

“We believe we have a right to hold our own public hearing on this issue, and we have not been allowed to do so,” said Geneva Ald. Tim Vetang, a vocal critic of the expansion plan.

Geneva has opposed expanding the landfill since it was first proposed last year by WMX Technologies, formely Waste Management Inc., which operates the county-owned dump.

WMX originally asked to expand the landfill by 7.7-million cubic yards. Geneva asked that the expansion be limited to 3.5 million cubic yards and that the county impose a closing date of May 2005, a date established in a 1987 agreement with the city.

“Under the county plan now, they could continue dumping trash there until 2025 if they wanted,” Vetang said. “We just want the county to adhere to its own solid waste management plan.”
