The Illinois Appellate Court has turned down the appeal by a man convicted of raping a 10-year-old girl two years ago.

Richard Johnson, 35, had contended that his 12-year sentence, imposed in April 1992, was excessive because the child had suffered “minimum physical harm,” according to the court decision.

But the justices noted the trial testimony by the child’s mother about how she had found her daughter’s underwear bloody for days following the attack in the summer of 1991. The child had been visiting an aunt in North Chicago and was alone with Johnson for about 20 minutes while the aunt went shopping with a friend, according to court documents.

The three justices discounted Johnson’s contention that the child had suffered little physical harm.
