player ready...The developers of Fox Valley Villages have threatened to sue after the City Council bowed to public opposition and altered the developers` plans for a commercial site at Illinois Highway 34 and Montgomery Road.
In a two-page letter dated Tuesday, Marvin L. Bailey, vice president and general manager of Aurora Venture, urged ”the council to reconsider its action.”
If it does not, the letter stated, Aurora Venture is ”prepared to immediately institute a lawsuit to strike the illegal condition. . . . While we hope that legal action will not be necessary, we will not hesitate to take it if forced to do so.”
Aurora Venture charges that the council violated zoning codes when it flip-flopped the location of a fast-food restaurant and a drug store at the site.
The council switched the sites last week after neighborhood residents complained that a proposed Burger King restaurant abutting back yards would have been a nuisance.
But Walgreen`s Drug Stores won`t accept the location slated for Burger King, because placing the drugstore on the rear of the site violates its national policy, said John E. Luczynski, Aurora Venture`s director of planning and engineering.
At Tuesday`s Committee-of-the-Whole meeting, aldermen and the mayor discussed the procedure for reconsidering the vote, which apparently would require the approval of 8 of 10 aldermen to raise the issue.
Ald. Marc Roberts said that he would move to reconsider the issue if he thought he could muster the votes.
Aurora Venture, a subsidiary of CC Industries Inc., is the developer of the upscale Fox Valley Villages on the city`s west side.
