Judge Raymond McKoski refused to dismiss charges that Jack Gail, 47, of Highland Park, plotted to kill Gabriel Ponzio, a Florida man.
Dennis Berkson, Gail`s attorney, argued that to try Gail on the solicitation charges amounted to double jeopardy.
Gail was sentenced to 14 years for buying drugs and the alleged murder weapon.
