A Gary man formally admitted he killed an elderly man walking his dog in August 2022.
Tyree Gaines, 28, pleaded guilty, but mentally ill Friday to voluntary manslaughter, a Level 2 felony. Under the plea’s terms, he faces 15-30 years.
He was originally charged with murder in the Aug. 17, 2022, death of Cornelius Olive, 79, of the 3200 block of West 21st Place, according to court records.
If a judge accepts the plea deal, a sentencing hearing is scheduled Nov. 6.
The shooting happened on the 3200 block of W. 21st Avenue, according to court documents.
On the night of the killing, Gaines was involved in an altercation, recorded on video, with his brother who also lives on West 21st Place, according to Post-Tribune archives.
Tyree Gaines told police he remembered coming across someone else and this person “was in his business,” the affidavit stated, and Gaines said he knew he “turned up” the person but he didn’t know what he did.
Gaines admitted in court documents that he drew a 9-mm gun and shot Olive multiple times. He told police after the shooting that he has mental health conditions and didn’t remember it.

A Hammond man was sentenced to a 7-year split term this month in a child molesting case.
David Arredondo pleaded guilty in July to child molesting and dissemination of matter harmful to minors.
Judge Gina Jones sentenced him to four years in prison, one year in Lake County Community Corrections and two years on sex offender probation.
The victim told police Arredondo abused her when she lived in his Hammond home from 2017 to 2020.
HAMMOND MAN GETS 16 YEARS FOR CHOKING GIRLFRIEND
A Hammond man was sentenced to a maximum 16 years in prison Friday for choking his girlfriend in 2023, according to a press release and court documents.
James Spriggs, 35, signed a plea deal in July for aggravated battery, a Level 3 felony.
Schererville Police responded Feb. 25, 2023, to an apartment on the 900 block of Sherwood Lake Drive.
A man called the police saying Spriggs was beating his sister. Another caller said Spriggs “may have been drinking” and was choking the victim, according to the charging affidavit.
Officers saw “deep purple bruising” on her neck. The victim told officers they argued and she threatened to call his probation officer, records show.
She alleged Spriggs grabbed her by the throat and slammed her to the ground, continuing to choke her, documents state. When she tried to call 911, he got the phone out of her hands.
Police wrote she was the “third” girlfriend he had attacked, charges allege.
